1. Scope of application

These General Conditions of Sale (hereinafter, the General Conditions) apply to any purchase of goods or products (hereinafter, the Products) made on this Website. www.somia.store property of SOMIADORES, SL, with headquarters at C/ Ausias March, 107 BJ 2 – 08013 Barcelona (Barcelona) and with CIF B67625566.

These General Conditions may be modified at any time, so it is recommended that each time the Customer browses or purchases a Product through the Website, they review them again, as those in effect at the time of purchase will apply.

2. Orders

2.1. How to place an order?

In order to purchase any of SOMIADORES, SL's products, the Customer must follow these steps:

The Customer may register on the Website to purchase the Products, but may wait to do so until the moment prior to formalizing payment.
To register as a Customer, you must provide a username, email address, and password.
To place an order, the Customer must select the Products they wish to purchase, which will be added to the Website's "shopping cart." Once all the Products have been selected, if they wish to continue with the transaction, they must click "Checkout."
The Customer must provide the following information so that SOMIADORES, SL can ship the Products: full name, full address, email address, and contact telephone number. This information will be stored in SOMIADORES, SL's database and will only be visible to authorized personnel. If the Customer detects that an error occurred when entering their personal information during registration, they may modify it in the "My Account" section. If the Customer detects an error in the order after completing the payment process, they must immediately contact Customer Service at the telephone number or email address mentioned above to correct the error.
If available, the Customer may enter discount codes or coupons to reduce the final price of the shopping cart.
Once the Customer has expressly accepted the General Conditions and entered the shipping information, payment may be made.

2.2. Availability and responsibility

All orders are subject to Product availability. If there are difficulties in supplying Products or due to a lack of stock, SOMIADORES, SL will refund the amount paid for them.

SOMIADORES, SL is not responsible for delays in delivery of orders or for the inability to fulfill them when the cause is due to force majeure. Force majeure events include, among other causes, accidents, strikes, fires, weather conditions, natural disasters such as storms, earthquakes, epidemics, and problems with transportation or telecommunications systems.

SOMIADORES, SL's liability in relation to any Product purchased on the Website shall be strictly limited to the purchase price of said Product.

3. Price/Payment

3.1. Price of Products

The prices of the Products on the Website are indicated in euros and include taxes related to the sale of Products, including Value Added Tax (VAT). SOMIADORES, SL reserves the right to unilaterally modify the price of the products and services offered through the Website at any time. To guarantee the Customer the certainty of the price of their Products, this price will be the price in effect in the advertising at the time the order is placed.

The price of the Products does not include the cost of shipping, which will be detailed before formalizing payment.

3.2. Pay

The Client has the following payment methods available when purchasing Products on the Website:

Debit/credit card: To pay by debit/credit card, the Customer must follow the instructions on the sales screen, providing the card number and type, identification code, and cardholder's name. SOMIADORES, SL uses the Comercia Global Payments service, which incorporates the SSL security standard. Confidential debit/credit card data is transmitted encrypted to the bank's server without being recorded on SOMIADORES, SL's server.

The Products will be purchased once these General Conditions and the Privacy Policy have been expressly accepted.

3.3 Billing

SOMIADORES, SL will send the Customer a confirmation of the order placed with all its terms to the email address provided.

The Customer will receive, along with the Products, the paper invoice for the order.

4. Product Warranty

4.1. Warranty Coverage

SOMIADORES, SL products are guaranteed for a period of two years from delivery against any manufacturing, design, or material defects. During the warranty period, SOMIADORES, SL undertakes, at its discretion, to exchange or refund products found to be defective. The warranty does not include:

Damage to the Product resulting from normal wear and tear, taking into account its nature, function and composition; nor
Any defects in the Product that may result from faulty installation, storage, preservation or assembly, a maintenance defect, incorrect use or use that does not comply with the technical or usage specifications (failure to comply with maintenance recommendations), modifications or repairs carried out by the Customer or a third party, damage caused by external objects, external events such as accidents, impacts, fires, acts of vandalism, damage caused by water, natural or artificial light (in the event of discoloration), natural disasters or adverse weather conditions.

4.2 Application of the guarantee

To apply the warranty, the buyer will contact SOMIADORES, SL customer service through the email address hello@somia.store or by calling the phone 695 09 44 79. Shipping costs resulting from the application of the guarantee will be borne by SOMIADORES, SL. However, the invoice must be presented to benefit from the guarantee.

5. Language

The Website, the published information, and the contract or customer registration form will be written in Spanish.

6. Applicable law, jurisdiction and competence

These General Conditions shall be governed by Spanish law. Any dispute arising from the application or interpretation of these General Conditions shall be resolved before the jurisdiction of the Courts and Tribunals of the city of (Barcelona), waiving any other applicable jurisdiction. However, any dispute that may arise between SOMIADORES, SL and the Client shall be resolved before the jurisdiction of the Courts and Tribunals of the Client's domicile or the place where the obligation is performed.

7. Processing of personal data

In accordance with Regulation (EU) 2016/679 (General Data Protection Regulation) and Organic Law 3/2018 on the Protection of Personal Data and the Guarantee of Digital Rights, the personal data provided through the use of the Website will be included in a database for which SOMIADORES, SL is responsible and which complies with the technical and organizational measures for the purpose of protecting said data.
